EU Regulation 679/2016 – General Data Protection Regulation

 

a.  Identity and contact details of the data controller

Premi S.p.A. with registered office at Via Gera, 16-18, Gessate (MI), Italy, tax code and VAT no. 09313920960, e-mail [email protected] (following as “Premi”), is the company that, as data controller, collects and processes your personal data, pursuant to EU Regulation 679/2016 General Data Protection Regulation (the ‘Regulation‘).

 

b.   Purpose of processing

The data you are providing us with by filling out this electronic form on the website www.premispa.com (the “website“) is necessary for us to enable you to subscribe to Premi’s newsletter and update you by sending you promotional material (via e-mail) about Berlin Packaging brand products, services (e.g., purchasing methods, home delivery, etc.), initiatives and events, as well as to conduct market research (to better understand your interests and be able to improve our offerings).

 

c.       Legal basis of data processing

The legal basis for the processing of your data for the above-mentioned purpose is your consent in accordance with Article 6(1)(a) of the Regulations.

In order to be able to update you about our products, services, initiatives and events, send you promotional material, including customized according to your country, or conduct market research, we need your explicit consent (pursuant to Art. 6, para. 1, lett. a) of the Regulations). In addition, if you wish to give your consent, Premi may use your shopping preferences to provide you with offers tailored to your tastes and needs. If you do not wish to give your consent, we will not be able to proceed with your registration to our newsletter. Your consent is freely revocable (see (h) of this notice) without prejudice to the lawfulness of the processing prior to revocation, including by simply using the link in all our newsletters) or by writing to [email protected].

d.   necessary data

We ask you to provide all the data requested as ” mandatory” (e-mail address) because it is necessary for your subscription to our newsletter; if you do not or incompletely fill in, your subscription cannot be completed.

e.   Method of data processing and scope of communication

Your data will be processed electronically in compliance with the regulations in force, in accordance with the requirements of the current provisions – and their subsequent amendments and/or additions – issued on the Protection of Personal Data, and, in any case, in such a way as to ensure their security and confidentiality and prevent their unauthorized disclosure or use, alteration or destruction..

Your data will not be disseminated. In order to allow you to receive our newsletter and to be contacted by Premi SPA, your data may be disclosed (limited to their respective sphere of competence) to the persons authorized to process the data of the companies of the Berlin Packaging group, to which Premi belongs (in particular to the parent company at EMEA level Berlin Packaging Italy S.p.A.), as well as the companies that provide us with services [1] useful for the management of our website or that carry out marketing activities on our behalf.

f.    Data retention

Your data will be processed for the duration of your subscription to our newsletter service or – in any case – until you revoke your consent (which can be requested at any time, including by using the link in all our newsletters); thereafter the data will be deleted or anonymized.

g.   Data transfers outside the European Union

To allow us to properly manage our website and the newsletter service you have requested, your personal data may be subject to transfer to countries outside the European Union where the parent company Berlin Packaging L.L.C. is located.

The applicable legislation provides that your specific consent to the transfer to third countries is not required as the transfer is made on the basis of the adoption of adequate safeguards as referred to in Articles 46 and 47 of the Regulation, such as the adoption of standard contractual clauses approved by the EU Commission.

The transfer of your data to any further third countries, where necessary, will take place in full compliance with the guarantees, measures and rights as provided for in the Regulation. By simple request to be made to the references indicated in Article 47 paragraph j), you may receive more information about the transfer of your data and the guarantees provided for their protection as well as the means to obtain copies of such data or the place where they have been made available.

h.   Rights of Data Subjects

By sending a communication to the e-mail address privacy.[email protected], you may at any time exercise the rights [2] referred to in Articles 15 to 22 of the Regulations, including knowing what data we are processing, how and for what purposes we use it, changing the data you have provided us with or deleting it, asking us to restrict the use of your data, requesting to receive or transmit your data to another owner, always without prejudice to the possibility of changing or revoking your consents.

You can also always object to the processing of your data carried out, particularly for marketing purposes by using the link found in the footer of each Newsletter, in order to unsubscribe.

i.    Who you can contact to complain

We would like to remind you that, if you consider that the processing of your data violates the provisions of the Regulation, you can always submit a complaint to the data protection authority (www.gpdp.it), or, if different, to the data protection authority of the Member State in which you normally reside or work or of the place where the supposed violation occurred.

(i) companies in charge of processing, managing and sending newsletters and promotional material;

(ii) companies that are business partners of the Berlin Packaging group;

(iii) companies that organize and manage market research on our behalf;

(iv) companies entrusted with the management of our website and related computer archives.

The names of all external data processors may be requested by communication to be sent to [email protected].

[2] Articles 15 to 22 of the Regulation grant you specific rights including:

  • obtain confirmation as to whether or not personal data concerning you are being processed;
  • to obtain access to your personal data and to the information indicated in Article 15 of the Regulation;
  • obtain the rectification of inaccurate personal data concerning you without undue delay or the integration of incomplete personal data;
  • obtain the deletion of personal data concerning you without undue delay;
  • obtain the restriction of the processing of personal data concerning you;
  • to be informed of any rectification or erasure or restriction of processing of personal data concerning you;
  • receive or transmit to another data controller in a structured, commonly used and machine-readable format the personal data concerning you;
  • to object at any time, on grounds relating to his/her particular situation, to the processing of personal data concerning him/her..

In particular, your right to revoke at any time any processing consents you may have given and to object to our analysis activities remains unaffected.

Furthermore, pursuant to Art. 21 of the Regulation, you shall have the right to object at any time, on grounds relating to your particular situation, to the processing of personal data concerning you carried out in pursuance of the legitimate interests of the controller pursuant to Art. 6(1)(f) of the Regulation.
